dad issued temp guardianship to maternal grandma

My daughter passed away in March, leaving behind two dhildren one of which belongs to the boy she was with at the time of her death and the oldest one has a different father. He wasn't involved in the child's life much after she was with the new one because the new one was exttremely jealous and controlling and he was abutsing. The natural father is on the birth certificate but there was never a custody order in place. When my dtr passed the boyfriend and his father who is calling all the shots left town with the kids. I have been trying to stay in contact and I have put up with a great deal of abuse from them even before she passed. She wasn't allowed to talk to her family or her friends. She would sneak around to do that now and again. But for the most part she was afraid. The family threatened her all the time that they would take the baby from her if they caught me or any of her friends around her or the baby. The look down their noses at me and call me trash. Well, I have no money for an attorney and have been waithg around for dad to go get the oldest one or to file charges on them for kidnapping. But he hasn't He has been contacted by the family that they want to adopt him and he said no., They even had an attorney call him. I have continually sent emails and called but they refuse to let me see my grandchildren becaus eof what they feel about me. Anyway, no that she is gone dad is the custodial parent from what I understand. He signed over guardianship to me on sunday and I am going to go first thing in the morning and file the paper to make sure they are enforcable. I am hoping because they have no legal rights to him that the judge will give me the order then and there and I can go get him. What I want to know is that when I do go if I am granted the temporary guardianship Can I make sure that they enforce that they have to hand over his birth certificate and social security card and shots records. Because they are going to be so angrythat they will try to refuse to let anything go. I am tgoing to take a sheriff with me just to do a civil standby if I am granted this by the court. How likely is it that I will be granted this as I have a letter from my daughter form two years ago that if anything happened to her I am to get the baby and care for him and now I have one from dad and I am the maternal grandmother and the people who have him have no legal right to him as my daughter and the kid share a child but weren't married and the father has nothing to do with any of it,. I have the letters. Neither of which was notorized but they are sighed and the one dad signed was wittnessed by a sherriff at the jail. That is why I am going to go and file the papers to make sure they can enforce the guardianship. Does he have to give up his shots records and the like? I would hate to have to make him start all over on his shots as he will be 4 in a couple weeks. Help. thank you

You have already gotten the answer to these questions. If dad #1 has been contacted by an attorney for dad #2, I'd be willing to bet that dad #2 has some type of temporary or emergency custody order. If dad #1 doesn't want custody of the child, chances are that a judge will go with the status quo and leave the child where he is now instead of taking him out of the home he shares with his sibling.

Dad #1 is going about this the wrong way. HE needs to go get HIS child. Then he can dump HIS responsibility off on whoever he wants.
