dads that receive custody of children having to pay back ex's assistance

My fiance got custody of his 4 children in the fall of 2000. He was ordered to pay $200 a month child support when the ex had them. He is behind on child support of $5000. He had not seen the children for 10 years when he got custody. The mother lost them because of drugs and going to jail. She lost them in the summer of 2000 and they ordered him to pay back the $20,000 (which they take from his wages and take all of his taxes) for the assistance she received in them 10 years(note: she got assistance while he payed child support). They didn't go after him for this money until she lost the kids. They are now garnishing his wages for the $5,000 he was behind in child support. The state of Virginia is the ones wanting this money and the State of Missouri wants it too. If a man gets custody of his kids because the mother is unfit to raise them then why should he have to pay all this money back. It is not fair to the children. All the money he makes from working ends up going to the state and on bills. The children end up going without the things that they need. Then you can't get any help from the state for you or your children because they go by your gross income. They don't care what is coming out in garnishments and that you make $2,000 a month and only bring home $850 of it. What is a father to do when trying to do right for his children.

If He was paying child support the whole time they said he wasn't and she was getting state aid all you have to do is prove to DCS that he did pay child support and he is not in arrears. If he paid and can prove he paid the child support they can't make him pay back the state aid.
