What is the name of your state? Illinois.

I recently purchased a car on ebay and had the vehicle shipped to my home. When the car was received the inital inspection showed no damage that wasn't already noted. After receiveing the keys the truck driver pulled away and I started the car to park it on the street. I was then made aware of a grinding noise coming from under the car. I contacted the seller and he told me that the driver had bottomed out the car as he was putting it on the truck. I am wondering what is the best course of action to take and if need be do I have a case for a lawsuit?

I think you are being fed a line of BS, and when it comes down to the truth the previous owner will not give a written statement claiming that they saw the driver loading the car, bottom it out. I suppose you didn't have a tech check out the car before purchase?
