What is the name of your state (only U.S. law)? California

Hi,

I just bought a house and have been getting some work on the interior of the house. The fence in the backyard had just fell over to our neighbor's patio and they had indicated that they had notified the previous owner that the damage was severe beforehand. I have not moved in yet and had signed the real estate agreement "as is." Does the previous owner have any legal responsibility to this?

**A: you have total responsibility as the new owner but you may be thinking about the seller disclosure statement. In which case, the Seller knew about the fence and you have recourse for non disclosure of a material fact.

I don't disagree if the damage to the neighbors property just happened. However, the wording of the original post was just enough to make me wonder if the damage was prior to the actual sale.

Ok...I thought we were talking about the damage to the neighbor's patio, not the damage to the fence....My comments were in light of who would be responsible for the damage to the neighbor's patio. Obviously the OP would not be if the damage happened prior to his purchase of the house.

The fence however, is another story...
