I live in CA and few months ago I hired a company to move my household goods from one city to another. Some of the items arrived damaged. I contacted the company and they sent me forms to fill out. I filled out the forms with whatever information I had and provided them with photos of the damaged items. With the forms they asked for original cost, reciepts, repair estimates and depreciation value. I provided them with the original cost and the depreciation value (estimates I came up with), but I didn't have reciepts nor repair estimates. I told them that I will be available any time their insurance agent would like to come to my house and estimate the damages.
After I sent the forms, the company asked again for reciepts, which I responded that I didn't have and reiterated to have their insurance agent come by and estimate the damages. After that I sent them two more letters of inquiries, which they didn't respond to. I didn't hear from them again until I sent them a letter letting them know that I'll be taking legal action against them unless they resolve the issue ASAP. They then sent me a letter asking for the same information they asked for on the original form (reciepts, depreciation value, and repair estimates)
My questions are:
- Am I expected to have reciepts for the damaged items? (Two mattresses, dinning room table, bed frame and a mirror)
- Am I responsible for getting repair estimates? I didn't because the items are large and the only way to get an estimate is to have the repairperson come to my house, which no one will be willing to do without a fee.
- I am planning on suing in small claims court, do you think I have a case without having reciepts and repair estimates?
