Damage to Vacation Property

What is the name of your state? Live in Tennessee - Vacation property Florida

My 17 yr old son stayed at a rental vacation property in Florida. The parents that signed for the condo did so knowing their child was 18 and no one staying in the condo was over 18.

The last night of the stay two teenagers (at least one a juvenile) were wrestling and put a basketball size hole in the wall, a tennis size dent in the wall and knocked the thermostat from the wall.

The child of the parents who rented the condo in a separate incident had a mustard fight damaging all linens, shower curtains, towels and extensive cleaning to several rooms.

The damage totaled approximately $1200 and the owner couldn't rent the property the next day and so is charging the parents $1800 for the rental loss and another $500 to pay for the gas of the family coming from Ohio to the rental and other miscellaneous fees for a total of $3,500.

Who is responsible for the costs? Is it divided equally among the teens? What are the legal/financial responsibilities of the parents who signed for the condo? The mother was in Florida at the time but not in the same facility... come to find out I am not sure if she was staying in the same city.

I am the parent of the juvenile that is responsible for the holes in the wall. They are wanting me to pay for more than 25% of the damage or they will file with their insurance to make a claim and then will charge my son with a felony count of vandalism? How is that handled if the damage happened in another state? I am willing to make restitution for my son's share (actually he will make restitution) but what is his share?

Is the "they" the condo owners or this other set of parents?

Based on your posting, I would say your lovely child would be responsible for 75% of the damages. Yes the other three (?) angels he was staying with did have a mustard fight, but spare towels and linens could be used and a cleaning crew could clean up the walls in an afternoon. They still could have rented the place if it was only mustard.

What are your legal responsibilities? To come up with the money before the owners file charges. After that, your legal responsibilities and restitution will be decided by the judge.

My son wasn't the only one that made the holes so I am assuming you feel he should split the 75% with the other boy; that is what I needed to know. It is the parents who rented the condo that have requested to be reimbursed because the owner was going to sue them. I want to make restitution, I just wanted to make sure I wasn't being railroaded in the process. I appreciate you taking the time to respond. :)
