LONG POST... This is my first post so please bear with my un-edumacated self. I purchased a product by phone (first mistake), and I received them damaged. Here's the whole story...

I ordered a pair of headlights from a vendor in CA the day after Christmas, which cost $1300.00. About 2 weeks later the items arrived (they arrived late). They were boxed in 2 separate boxes which was then placed into a larger box. UPS left them on the porch without someone signing for them!!! I opened and only inspected one light (which was fine) and waited about a week before attempting to install the lights due to weather issues. On the weekend of MLK's birthday, I went to install the lights. To my disgust, one light was damaged. I could not contact the vendor due to the holiday weekend, so I had to wait a few days. When I did contact the vendor he totally denied any responsibility and blamed UPS for any and all damage. I attempted to resolve the issue with him, but to no avail. UPS was contacted and they were suppose to p/u the units to investigate the damage. This did not happen because the original shipping box was not available. Still the vendor just told me, "sorry, it's not my problem", I disputed this and told him I did not want to deal with him anymore and that I would contact my credit card. I was told it was illegal and that I could not do that. Visa disputed the charge and after 2.5 months I received a letter stating the issue has been resolved. Now I was stuck with a pair of headlights that is damaged and paying $650 for something useless. I attempted to resolve this issue again with the vendor and paid for the shipping back to the vendor. The vendor refused the shipment and denied receipt of the package. I then had to pay for the return shipment (totalling $130.00).

So, Visa has attempted to resolve the issue and I attempted to resolve the issue and paid for the shipment back to him. The vendor has denied any claim to the units and refused the shipment. Am I still liable for the $650.00 to the vendor which Visa has re-credited me and have to send the units back again? Can the vendor sue me after I have attempted to return the product to him?

Is this confusing? Am I asking the correct questions? If anyone can understand my situation, please HELP!!

Follow-up...

Can I keep the damaged items and not have to pay for the other $650? I have contacted the manufacturer and I can fix them at my cost. Do I have to return the product to the vendor if he asks for them or did he waive rights to the product when he refused the package? Visa stated to me it is a closed issue when he has refused the return package at my expense, are they correct?
