In excess of 90 days ago I had a fence installed by a legal contractor. He failed to complete the project on or before the completion date. The contract clearly states the project must be completed by specific date. We continuously called the contractor, in order for him to complete the fence .. never returning our calls. After three months, he called wanting payment. Are we obligated to pay him or can we walk away, leaving the fence as is and still "owing him money" ? Secondly, if he does complete it, are we obligated to pay him, even though its in excess of 90 days??
