Daughter 15 "Needs Help Immediately"
What is the name of your state? I live in Alabama but my daughter who is 15; almost 16 at the end of May 2005 lives with her dad in Orlando, Florida. My daughter is skipping school; running away to friends and her brother's house who is in college. Her dad reported her as a missing person however she has tried to explain to him that she doesn't want to live with him but all that he is concerned about is not having to pay child support. I have had HRS involved many times because of mental abuse on the children but it can't be proven. I have spoke with an attorney last year and he told me that if my daughter wrote a letter to the judge and he presented it to the judge that he is very sure the courts would allow her to change residency. My daughter has since left her father's home and arrived up here in Alabama by grehound bus. Keep in mind that she was only a missing person and not a runaway. I notified the police of which we have joint parental responsiblility of the children but they reside with him. The police took her off missing person list and said she was safe at my house and they wouldn't do anything further. I have contacted attorney's and they told me they could get temporary custody ASAP but now he has charged me with several contempt orders like failing to put her in school; of which I can not do but am following up with a present attorney and failing to pay child support even though Social Security is sending it out of my check somehow he is not getting it and he has possibly charged me with failing to visit every other weekend of which that order was in Florida when I lived there but was not mandatory. They are silly contempt charges and I believe they will be discharged if I can act quickly. What do you people feel as far as this? He will not freely give up custody of her because he doesn't want to pay child support and he feels she is best there but he has left all the children home alone for approximately 10 years while he worked 2nd shift for Disney World.Apparently HRS says it's ok but I don't understand the laws. A child can tell the police that a parent has touched them in a wrongful way and the courts will believe it no matter what but yet if a child says they are unhappy,can't focus in school, is depressed because of mental abuse and is scared of the father not only poisoning her cat but threatening to kill her mother the courts say it's all hear say. What does a person have to do in life to get heard and protect their child? I had to give up custody because my attorney told me she needed more money because it was going to be a long dragged out fight and I had no more funds and I felt after getting a home of my own I could go back and get the children. My attorney advised me to give up because my exhusband had the funds to continue how ever long it took and he did. I was a full time mom that never worked so my exhusband really looked good in court. Now I only have 1 underage child that is suffering the mental abuse that I had suffered and I desperately need someone's help out there before my daughter runs away and we can't find her or worse yet; the law finds her dumped somewhere. Once again; her father will not freely give up custody. If she continues to runaway and miss school will the juvenile courts get involved and give me temporary custody until they can read her letter and it goes before the courts or do I have to go back to court and fight? I don't like fighting! I'm scared too that he will come and kill me if I do get custody! Please someone out there help me to know what I can do to make this issue move forward quicker.
