daughter 21 ny - have to support thru college?

What is the name of your state? New York
My husband's daughter turned 21 this weekend and her mother (never married to father) says the support has to continue until daughter graduates college in June. Nothing in support order references anything about that. No other agreement exists other than standard child support which was followed without arrears.

Everything I read says he is not responsible to pay support after she is 21 even if she is still in college (college is not paid for by mother - grants, fellowships etc - a city college not private)

Is this true - does he have to pay until she graduates?

If the child support amounts were modified from time to time, go back and check his original divorce decree to make sure that nothing was mentioned about child support being in effect until she graduates from college. You may be looking at modification paperwork and it may not reference all of the provisions of the original orders.

Other than that, from the links provided by the other poster, it doesn't look like he is obligated to continue to pay support. However, if her mother was actually using that money to cover expenses for the child, he might want to consider helping his child out by covering those expenses himself.
