daughter hurt on carnival ride

My four year old was hurt on a carnival ride. She was the only rider getting on the ride and was not seated yet and the operator started it. She was thrown to the ground and basically run over by the tires. I had to tell the man to stop the ride he did not even know what had happened. She had tire marks on her face, arms, back and legs. She thank GOD was not seriously hurt. The owner of the carnival called me yesterday to ask the name of my attorney and told him I did not have one. I do have an appointment set up for tomorrow to see a doctor because her arm is hurting. She is petrified. She has had 2 nights of nothing but nightmare of that car running her over and to say the least I am also a mess. Can I sue and what legal ground do I have if she was not very injured? Thank you!

The carnival equipment owner should have liability insurance for these types of accidents. You probably do not need to sue as long as all your medical bills are covered. If you have medical insurance, your own medical insurance should cover most of the bills. Sounds like the ride operator was negligent. If you are looking at the possibility of receiving other compensation besides medical, talk to an attorney for case evaluation.
Your priority though is to have you daughter evaluated by your family pediatrician or GP MD so that any injuries can be treated accordingly and fully documented. In addition to any physical injuries let your doctor know that she is having nightmares etc. He may refer you to counselors that you and your daughter can see for help.
