How much time would a minor boy get in juvenile hall if convicted of rape/sexual assault? This boy that my daughter is "dating", meaning went to prom & another dance with, was locked up for 9 months & is on probation for 5 years, until he's 21. I don't know if anything can be looked up on the internet since he was a minor. My daughter is being blind about this guy & I told her that it's serious if they lock a juvenile up for that long. Also, would they charge him with rape if he didn't do it? They would have to have proof from a rape kit at the hospital, correct?

There is no way to say how much time he might get based upon unknown charges and circumstances. Nine months seems awfully short for forcible "rape", so you might not have the correct offense in mind. But, juveniles tend to receive lighter sentences than adults for similar offenses. Perhaps it is for unlawful intercourse (aka "statutory rape") with someone under 14?

As he is a juvenile, there will be little to no details available to you. If your daughter is a minor, you can always take steps to prohibit any further contact if you can or wish to get into conflict with your daughter. Alternatively, you can allow contact, but do it at your place, in your company,and at times when you are around. I have seen this work to great effect with the parents of girls I know of (My experience is with 4 sons). If he wants to be respectful and proper, he won't have a problem with such restrictions.

Ultimately you can control your daughter's activity if you choose to. So, it maybe time to have a sit down with her and inquire as to what this is about and why she thinks so highly of this guy.
