David vs. Goliath

This may be a David vs. Goliath battle that I may lose...I bought a John Deere riding lawn mower on May 23rd from Home Depot along with a bagger and a cart. I mow the lawns of a few neighbors for extra date money (I have a day job so this is something that I do in my spare time). Something is wrong with the mower to where it cuts very uneven and chops the grass. Just about everyone that I've used it on has complained and said not to use it again so I contacted Home Depot today to return it. After explaining what the problem was I was told that I voided my warranty by using it for commercial use and so I'm stuck owing them $2800 for something that I can't use. I was never told of that I would be voiding the warranty even though I told the sales person what I would be using it for. I also spoke with a manager last week who said he'd have John Deere call me (which hasn't happened). During that call he never mentioned anything about a warranty issue. Am I out of luck here??
