Daycare Assistance

I live in New York. Prior to us marrying, my wife was receiving government assistance for daycare for our child, about $400/month. Our child would stay with her grandparents and they were the ones receiving the money. When we were married, we were surprised to find we still qualified for that assistance. As it turns out, my income was not claimed on the forms and they didn't know we were married so it was still just benefit for my wife. We've just received our tax returns, so we have the money to repay the amount owed. We've received a phone call informing us of the situation, we're aware it was our fault, and that it was stupid. We've been told we'll have to wait a month before we know what to do.

So given all that, here are my questions:
1. Is it worth a try to simply call/head down to the office and offer to pay it back? Or could that be used against us in some way?
2. Is the month wait so that charges can be brought up?
3. Is there any chance we can settle and simply pay it back?
4. Do my wife or I face a possibility of jail time?
