daycare made mistake now charging for previous months.

OKlahoma - our children recently moved to a new daycare facility. In doing so, we went from DHS support to self-pay (completely out of our pocket). Our application states that we are self pay. The daycare failed to process the info correctly and hadn't charged us the correct amounts for the past 3 months. They had it in their system as having DHS help. Now they are trying to get us to pay back what they say we owe, even though it was their mistake and my wife repeatedly asked them if they had us as 'self pay' and they said yes. Do we still owe them the money or is it their loss?

Since the agreement you had was self-pay, you knew you were liable for payment. Their mistake does not relieve you of that liability; however, since paying the 3 month amount at this time may be a financial inconvenience to you, caused by their mistake, they probably would be required by a court to allow you to make the payments on installments.
