"daycare" payments?

What is the name of your state? CA
for a friend.
Daycare cost to be split equally by both parents for work related daycare as per divorce decree.
Biomom has live-in boyfriend and during Spring break, is saying she will be paying live-in bf 120$ for that week, making dad's half to be 60$.
Child is 10 1/2, if that matters.
Bio dad offered to take child on days he does not work which are not his visitation days, but mom said no.
So, what to do?
Also, same family-
biodad has child for entire summer and plans on getting child into YMCA program for working days-is biomom responsible then for half the cost? She's saying no....

The boyfriend will have to claim all money on his taxes as income. The dad will need to ask for proof that these monies are being paid by bio-mom, including the words "daycare services" on the check, and the bio dad will want to keep copies of those.

As to your second question, yes, bio mom will be responsible for 1/2 of daycare costs incurred while child is at YMCA as long as court papers state that daycare costs are to be split between the parties.

A question.

Wouldn't "daycare" be interpreted to mean just that, DAYCARE? I only use cerified daycare, as I wish my child to have quality programing when there, a guarantied amount of physical activity time, etc. The Y has DAYCARE, her BF is NOT Daycare, he is just a sitter. Will the child have interaction with other kids? Structured programs? Or will the BF stick the kid in front of the TV and let him stagnate? Or worse, let him watch inappropriate garbage on TV?

Unless the BF has a background in education and certification, I sure would not consider him to be "daycare".

Is there a guideline in these orders as to what is intended when one refers to "daycare"? Can a child be dumped in anyone's care and claim it is "daycare", because I see a big difference between a sitter and daycare.

Home daycare is fine, and I know of many that ARE certified (or run by parties with the proper ed background, or former providers at a certified program), just think that a certifcation is something a parent would want in a daycare.

Agree with you whole-heartedly about daycare vs..

sitter. That's why I suggested to dad the Y program for the summer-pretty cheap and they keep the kids pretty busy (worked for Y a few years back)
I guess dad could refuse to pay, see if she brings this to court, then maybe a judge could clarify what "daycare" means---and possibly bring all you mentioned up? not advising this, mind you, but maybe another option? possibly bring up that dad offered to take him during this time when not working....no "right of first refusal" in papers, but, that would decrease the need for daycare provider, right?
The bf, from what I understand, does not work so not sure since his income is nothing, if he would have to claim this for tax purposes anyways..
Oh-and biomom still has some personal possessions of biodad--things like a flag that was draped on his dads coffin---biomom wont give it back unless he agrees to pay half this "daycare"--can you believe this??
