What is the name of your state? West Virginia. My neighbor and I have battled over his dangerous tree for 16 years now. This tree is monstrous -- and now it is also dead. I think it's a White Birch. It no longer bears leaves and is now stripped of its bark. A friend of mine came to visit me recently and I forgot to tell him not to park in the driveway. During his visit, a huge branch fell on the hood of his car and damaged it to the tune of $600. I have posted questions about the tree here before, and you have kindly and quickly made me aware of the laws, but I'm wondering if the law still applies when the tree is dead. If I cannot get my neighbor to do something about the tree, do I have any other recourse? This tree will surely fall. I recently had to apply for disability and I can't even afford to have it trimmed! Thank you for your quick reply.
