What is the name of your state? Illinois. After a divorce, my husband was given responsibility of our Durango which had me as the primary name for that vehicle. He never took my name off the contract or re-financed in his name. Now 4 years later a collection agency is doing their usual tactics with me (threats etc...) I faxed them the court papers stating all financial responsibilities were on him. They don't care and say they're going to garnish wages if I don't pay them the "discounted" balance of $2000. I gave them his work phone # and don't care about that either. Should I pay?

Should I pay?

Yes, if you don't want to be sued and you will lose. Your court papers is a matter between you and your ex, not the finance company. Pay the bill then sue your ex for not upholding his part of the agreement.

One more thing, they can NOT just garnish wages .. they would have to sue you first and win a judgment, Then and ONLY then could they garnish anything !
