I hope this is the right section for this question. About a year ago I made the mistake of letting a friend sell some items for me on EBay. It was totally stupid of me, especially since I never got an agreement in writing from him. It was strictly verbal. It wasn't junk items either. The items in question were boxed Barbies, numerous porcelain figurines and numerous books. I have several questions. 1. Is a verbal contract as binding as a written one? The terms we agreed on were quite specific. 2. If I have a leg to stand on, would it be possible to obtain the sale information from EBay? Any and all help would be appreciated.

Go to EBay and look up your friend's username. Then look up his sales history. If you find your items you will then know how much he sold them for.

I know how much some of the items sold for. The problem is that I'm going to have to subpoena Ebay for his history, since it's been almost a year since they were sold. My question still remains, is a verbal contract binding?

Only if you can PROVE that you have a verbal contract with the other party. (In other words - no).

Thank you, that's the kind of information I needed. I'm trying to get a sworn affidavit from a person who knows the terms of the deal I made with my friend and who is a first hand witness. Wish me luck.
