What is the name of your state? michigan
i have custody of 1 of my boys and his mother is on SSI i know she can work, she has had several under the counter paying jobs. She is $2,000.00 in arrears and i was told by F.O.C. that i have no course of action because she is on SSI. I have never recieved a penny from her. Consequently i have paid over $26,000 in support to her when she had custody of him. Do i have any options in this case?
My other case is with my 2 sons from a different mother. I have had custody of them from day 1. Their mother is $19,000 in arrears and she can work. She gets paid by the state of Michigan for caring for her boyfriend who was involved in a car accident some years ago. Again it seems that this money is not available for F.O.C. to garnish. Please let me know of any actions you think that i can take in either of these matters. thank you

So there are 2 deadbeat mothers who you are unable to collect support from? One is on SSI and it's not being garnished?? And none of them are paying? Is there even an order requiring their support? Some of this doesn't sound right.

No, it does sound right, unfortunately for the OP.
SSI cannot be garnished. (SSDI can though).
Apparently, the other mother is recieving some form of assistance that is exempt from garnishment because it is actually part of the BF's medical care expenses.

I can understand where nothing can be done about the mother on SSI, but it does seem like something can be done to at least hold the other mother in contempt for non payment, given the situation that she's not working in order to care for a BF (not a spouse).

Although the mother of the 2 sons' "income" cannot be garnished, has the FOC said anything about filinf to have her held in contempt?

That is a possibilty that should be looked into. I don't know MI laws real well, but it seems like a parent who isn't paying CS wouldn't be able to convince a Judge that they "can't" work or support their child because they are busy taking care of the BOYFRIEND.

Okay, know about how it works with the 'caring for the BF'. They are actually NOT employees there, but they sub-contract out. So, mother is 'self-employed' there. I know this because the dad of my daughter pulled the same stunt.

Your best bet is to write a letter to enforcement. You can hand deliver it, fax it or mail it to your enforcement person. Depending on the length of time it's been since the last show cause, they'll order another one. The person in contempt had best show up with purge money, else, they go directly to jail (almost like monopoly there.) Now, if you ex doesn't show, they'll issue a bench warrant for the purge amount. It is up to you to see how far you want to get this person. I left mine out there with a bench warrant because I felt then that he wouldn't keep dragging me back to court (12 times in 5 years), since he couldn't go into the courthouse :D;):p:D He did get picked up 22 months later.

Remember, squeaky wheel works VERY well with FOC. My arrearage never got as bad as the other moms because I kept up with requesting enforcement every 6 months. She benefited from my actions because purge money was asked for both cases.

I thought that there was an amount added for each additional dependent that a person on SSI got. If dad has custody, then dad gets the check. Am I wet here?

Yep, you got the 2 confused, but that's easy to do.

SSI is actually a form of welfare and SSDI is actually a form of insurance.

A person can collect SSI even though they've worked very little.
A person can collect SSDI only if they've worked a certain amount of time and paid SS taxes.

the 2nd mother in question has actually been jailed for failing to pay support 30 days on 2 seperate occasions. It just burns me up that if it were me (the father) my ass would be locked up or forced into finding a job to support my children. I think the the laws are biased toward women. It is unfortunate for my children who love their mothers, i am sympathetic towards not wanting them to have to deal with this and hoping they can continue to carry on a relationship with their moms. I just find it difficult to deal with them face to face knowing that they are in the wrong. Thank you for all the responses your help and input is appreciated.

SSI cannot be garnished, only SSDI can be garnished. In fact, a judge cannot even force compliance on someone on SSI. SSI is also not much money at all...its only about 600.00 a month, with no dependents benefits.

I don't have a clue what's up with the other mother.
