Please help, I live in San Diego Ca, I was involved in an accident with my leased, 1999 Ford truck, front damage, and engine destroyed from overheating, had truck towed to dealership I leased from for repair, all repairs were approved and paid for by my insurance company from start, it was determend that I would need a new engine, front end repairs, and body shop work.
Service manager promised that my vehicle would be completely repaired and driving my vehicle in three weeks.
This was on Dec 10, 2000, I authorized my insurance co to pay dealership for all repairs and for them to begin repairs, fully expecting my truck back by Jan 1 2001 as promised!
As of today Feb 21, 2001, my truck is still not repaired and I was told by service manager that they had received some wrong parts and diden't think my truck would be done for at least a couple more weeks!
This vehice is my work truck, my insurance co authorizes a maximum of 30 days rental vehice, that ended on Jan 10, 2001
since then I had paid out of pocket, well over $1,000.00 and could no longer afford it after that, I need my truck back for work now, I have lost numerous jobs, because of not having my truck, what can I do get my truck back, as well as recover the out of pocket costs I suffered since there promise of three weeks is turning into 3 months, do I have any recource or rights to force them to give my truck back or provide a loaner/rental truck?? sorry so long, any help will be greatly appreciated

I am a law school graduate. What I offer is mere information, not to be construed as forming an attorney client relationship.

Get a lawyer. You can either sue to get the money for the car and get yourself a new one, plus your out of pocket expenses or you sue for the car (repaired) and out of pocket expenses. You might even be able to attach the legal fees if what they did was malicious.
