Dealer responsible for damage to new vehicle?

What is the name of your state (only U.S. law)? New York

Spray in bed liner is part of contract as it comes with this trim.
Dealer has their contractor spray in liner.
When picked up vehicle all tie downs had been sprayed over so dealer will have contractor correct the problem.

While truck is at dealer to attempt to correct spray in bed liner truck is hit by dealer contractor.
The dealer picked the truck up at the contractor and took it to their lot before contacting me.
Damage is serious enough, requires new door at least.

Does picking up the vehicle constitute acceptance?
Does the dealer have to make this whole for the loss of value and use of vehicle?
Can dealer be compelled to buy the truck back?

Unless you can show the dealer was negligent in some way I don’t see the dealer liable for anything. The bed liner guy caused the damage and thst is who is liable.

The contractor would be liable for repairs and diminution of value.

I don’t see anything that would require the dealer to buy back the vehicle


Now if the sale hasn’t been completed I would rescind the contract and refuse to accept that vehicle. If title has been transferred, or paperwork already filed to transfer title, I think you’re out of luck on a buy back.
