dealer tricks?

Recently while shopping for a new van a dealer talked my wife into bringing one home for the night to try out. While in our possesion my wife dented the rear bumper and now the dealer expects us to pay for it. We turned it into our insurance and they denied the claim, saying it is the dealers responsibility. The dealer is suing for damage to the vehicle. Are we responsible? We signed no papers when we took the van saying that we would be responsible. Do we have a leg to stand on?

Your wife could be responsible if she was negligent while driving the vehicle; they would have to be able to prove negligence, but if they do, we are all liable for damages that flow from our negligence-we do not need to sign anything agreeing to it to be liable.
