Dealership is selling the truck we just bought

On 4/22, my husband and I purchased a used truck from a dealership. We made our down payment, signed all required paperwork, were approved for financing through a bank, and have all required documents including bill of sale. We left with the understanding that the dealership would fix a couple of minor issues with the vehicle and we would pick it up later in the week. We received a phone call stating that repairs on the truck would take longer than anticipated, can they give us a loaner? The next day, we were told that the vehicle had even more problems, and would we be interested in buying another car? We said we would consider it, if there were an equivalent deal, but we had not confirmed nor were we offered an adequate replacement. Within an hour of that discussion, the truck we had originally purchased was listed for sale at a sister location at the same price we bought it for, 3 days after we had bought it. For what it's worth, this is a larger, well known car dealership, not a small, hole-in-the-wall car lot.

We are trying to figure out what to do about this, and whether this is a breach of contract in some form. We figure we have three options: fighting for the truck we purchased, taking our money and walking away, or seeing if there is a suitable deal that we are offered. This has left a pretty bad taste in my mouth, so I'm not inclined to entertain any further "deals" we're offered, but any advice or similar experiences would be helpful.

Car dealers are liars and thieves, even the bigger, better known ones.

I couldn't say if it's breach of contract or not but (this is not legal advice) I'd go back and get my money and go elsewhere.

I would avoid buying used vehicles from car dealers.

Go to your bank or credit union. Get approved for a loan so you know your limit. Then buy a truck from a private party, being sure to get it examined by a mechanic before you hand over any money.

Before you get a bad taste in your mouth, ask yourself why they would do this?

Their business is selling cars(trucks) and they sold one to you. Now, they stopped the sale and put the same vehicle up for sale to others. Why? What was wrong with already having a sale for the vehicle where the dealer would want to cancel that and re-sell it to another?

They want to sell it for more

They want to sell it without making extensive (any) repairs

They want to sell it to someone who drives a less hard bargain.


All of these are possible and not mutually exclusive.

As to the other reasons, you are still taking a sale of a vehicle and changing it to two maybe sales of vehicles. It is hard to change maybe to a sale. For a business who's job is selling cars, the maybe's stated do not give rise to it being a profitable decision. The only way for a business to be long-standing is to make profitable decisions.
