What is the name of your state? NY

If an owner of a variable life insurance dies (not the insured), does that ownership pass to the spouse although there is no such provision in the will of the deceased. Also, can you tell me the specific law or regulation that states the anwser as I am a student doing a research project and I am having the hardest time trying to find this information. Thank you.
