What are the landlord's rights to take possession of the premises and dispose of a deceased tenant's personal property when the immediate family is reluctant to give any guidance due to no contact with the tenant for a long time, no will, no value enough to have an estate? What "legalese" should be contained in the lease to cover such an event? West Virginia

You must contact the probate office, assuming the family has NOT hired a lawyer to handle this....and see if the judge will issue you an order to move the stuff into storage.....or to release it to the family so you can re rent the apartment.

You must also put in a request for any rent, and damages the tenant owes you. and you must be paid before the family gets anything......was there any life insurance?

dont be to sure there is no assets......we assumed this old lady had ONE brokerage account....then she got a special dividend from 3 companies and we started searching, she had 5 shares in 50 different companies in 12 brokerage accounts...no kidding.....all to a po box
