I have a divorce decree, issued in Arkansas, which states that my ex wife will indemnify me from liability on a joint car loan that we had . I was the co-maker. She has become deliquent on the loan and the car has been taken back by the bank. They are now asking me to pay the remaining debt left after sale of the car, and threatening to take me to court. Do I have any rights ?

My response:

Yes. Once the bank files a Summons and Complaint, and then serves you with the same, you can then file a Cross-Complaint for Indemnity, Breach of Contract, and for Consequential Damages against your ex-wife.
