What is the name of your state?What is the name of your state? I live in Georgia. A collection agency called and want to collect on a debt that is at least over 10 years old. It was originally about 2000.00 now it is is well over 11,000. I know the debt was written off years ago. Can they still try and collect on this? It is not the original creditor, it is a collection agency. I am also now unemployed and am disabled without income. I do not want to establish communication by way of sending them anything as this will re-age the debt to current date. Do I ignore the calls or tell them I will only pay what the original loan amount was? :confused:

Your post doesn't say whether this debt is an open account (4 year SOL) or written (6 year SOL), but if it has been 10 years since your last activity, either way the SOL has tolled on the debt.... making it unenforceable.

Yes, they can try to collect.... but as noted above, if the debt is really 10 years old... they can't force you to pay it. If they were to file a lawsuit, your defense is an easy 'SOL has tolled on the debt'.

If it was me, I would not pay anything on this old, dead debt. Simply, send them a 'cease and desist' letter telling you to not contact you again. A good sample letter can be found at: http://www.creditinfocenter.com/forms/
