Indiana - I was recently a victum of a scam. I ended up cashing a counterfiet check without knowing it and now the bank wants the money from me. I spoke with a local attorney who said not to do anything like try to file bankrupcy right away as if they are going to fight over it, the longer I wait, the better. I got a notice saying I'm being sued by the bank. It says I must answer the complaint in writing within 20 days. What I don't understand is the last paragraph which reads:

"If you have a claim for relief against the plaintiff arising from the same transaction or occurrence, you must assert it in your written answer."

I don't know what this means. Does that mean if I intend to file for bankrupcy I have to do so and send it in with the letter? Please help me. :(

No, that's not what it means. It means if you have any issues with the bank arising from this scam/fraud you must say so in your Answer.

Did you report this scam/fraud to the police ??
