What is the name of your state (only U.S. law)? North Carolina

Some money is owed to a nursing home by my mother. Since I admitted her to the home, they are now seeking to collect from me. Unfortunately, we exhausted all of her assets on medical care. I am currently on medical leave and am having difficulty making ends meet on disability. We are having difficulty with insurers and are in very tight straights financially. The debt collector called and started asking a lot of questions about not only me but now my husband. They knew his social security number and date of birth. The debt collector said he is trying to help up put a hold on the claim so that it doesn't go to court. I would like to believe that is true, but I am very wary of providing information on my husband. If I had the money I would pay this debt off, but we are not able to do so at the moment.

Can they go after my husband for my mother's debt? What are my rights, my husbands, and what can we do to prevent this from getting worse? I am afraid they will garner my husband's wages or my disability and we not even making it pay check to pay check right now. What is the name of your state (only U.S. law)?

I am not an expert on this, hopefully one will answer your questions soon. But,I am almost positive that the nursing home cannot garnish a government check for disability.

Since your husband did not sign any papers at the nursing home I think his wages would not be able to be garnished. I am not as sure about that but hopefully one of our more experienced members will know.Good luck.
