What is the name of your state?Indiana. My wife signed a one year lease 3 years ago, before we married. Now we are moving with our new daughter and unfortunately we have fallen behind 2 months rent. The LL refuses to speak to me because I am not the person he has dealt with in the past. We offered to make payments on the balance but to no avail. We have notified him that his house will be empty in 3 weeks. He has sent someone here to demand payment in person and now he has a guy in Texas calling my wife's place of employment misrepresenting himself and divulging information about the debt. There are several violations of the fair debt collection act, which indiana adopted as written by the trade commission. Most of all he is calling my in-laws in N.Y. asking them for the money. All I have is his name and the numbers that come up on my phone. How can I get this guy to go through the collection process properly, which I am prepared to do?

Send the collector a letter reminding them that they ARE bound by the FDCPA and that they are violating that law with their actions. Tell them they are to cease all PHONE contact, and all contact should be to you, IN WRITING ONLY. Then you might add that if they don't mind the law, you'll sue them for their FDCPA violations. Keep a log of their illegal activities.
