I was separated from my wife (Washington). She died before a divorce could be filed. Am I liable for her debts after the separation? Specifically, at the time of her death she owed back rent to the apartment we lived in (she remained in the apartment after the separation). Am I liable for the promissory note for back rent she signed?

My response:

Washington State is a Community Property State. Since, I presume, you were not "legally separated" - rather, merely living apart - then yes, you were still married and are on the hook for her debts.

Had you been "legally separated" at the time of her demise, then you would not have been obligated.

Community Property States require ongoing support and obligations to each other throughout a marriage, despite separation, unless a court has ordered a "legal separation".
