I recently received a summons for a doctor debt , The Debt is good. wife tried to work out deal they refused but still accepted 25 dollar payment in early August. I paid the collector in full prior to receiving Summons in Mail. (Summons signed 15 aug, Debt paid 17 of Aug) Summons was not delivered. But regular US mail and received 1 Sept

Can I move to dismiss in an answer to summons as I have cancelled checks showing debt paid in full? Actual i Paid in excess since i could not get answer to the total amount of of Debt ? Debt was 234 paid 300 to collector. I have been able to reach Lawyer in Office to discuss yet.

Bill collector is a lawyer

Any Suggestions ?

Yes.

Just make sure you do a little research on how to file motions.

You might find a generic form on your court's website. If not, look for one in the bigger venues like Cook County, or online for a sample that you can modify.

A copy has to be sent to the other party.

Attach your documents to the motion.

The other party will have a chance to respond and the judge will make a decision.

Don't be surprised if the other party wants to add court costs and attorney fees to the amount claimed.
