declaring custody??

What is the name of your state? Florida

My son is 1 mth old and I am not married to his father. Do I need to declare sole custody and if so how? And when it comes time to go to court is it acceptable at this time to request daytime visits w/no overnights and for him to have visitation on the days he doesn't have visitation with his other son? I asked for the wellfare of my child, I know he would not be able to handle and care for more than one child at a time. He couldn't with my 10 yr old and his 3 yr old, and when our son was born he would pass him off as soon as he starts crying and now barely makes any effort or time to spend with him. He can barely tend properly to his 3 yr. old. Visitation will be an issue though because he hates to lose or look like a jerk to others.

If you have not filed for custody, visitation and/or support and do not need the support, then why file at all? At the present time there is no LEGAL father and although the child does have a biological father (whether or not it's him) that person has no legal rights until such is filed for in a court of competent jurisdiction.

unfortunetly for a little while I am out of work and am (only temporarily) on assistance an they require it. He does on occasion (if it is not to out of his way) stop for a few minutes to see him.

Well then, follow through. Until he files for visitation or joint custody with visitation then there's nothing he can do. HOWEVER, when that does happen, it's not a requirement that he exercise his visitation.

And remember, guidelines are only that. They are not law.
