What is the name of your state (only U.S. law)? WI
Decree is court order, right? If the two conflict, what’s the chain of command?

I’m a friend of divorcing dad and he is getting super frazzled. I think his lawyer sucks. He keeps asking me, what does this mean?

Do Family Court and Criminal Court converse amongst themselves? It is my understanding they are two completely different entities. There is child abuse charges involved. Our judge came down on them pretty hard at family court so I’m guessing he is the one that recognizes the correlation. We are in a small county.

Dad is computer illiterate and just gets more frazzled when I try to steer him to any self help sites. The temp court order is very short and clear. The decree is four pages long. It makes sense to me, but I do understand the conflict.

Quit trying to steer the Dad.

If you want to help pay for and tag along with Dad for a consult with a Family Law Attorney,having Dad take ALL documents involving the cases.

What makes you think Family Court shouldn't be involved in abuse ?

Family court is involved in the abuse as far as I can see. Mom and dad are both being held accountable. Does the Family court tell the criminal court that? Or, because this is such a small county that the judge sees this?

The court order and decree conflict. Who does he take it up with? He's trying his little heart to follow all orders. I tell him to document all this and bring up with his lawyer, but even I'm not comfortable with the advice and all I know is from this site. Dad would like to get another lawyer, but he is very tapped out. The bills must be paid.

They have kids and they are not co-parenting in any way. Hence, the decree. Thanks for your thoughts.

If one is temporary and the other is permanent, the permanent one rules. Also, the most recent order is the one that counts.

The best way you could help Dad is step back and let him deal with his divorce himself. Your involvement could seriously harm his case.
