Deep Fryer failure

My daughter was injured at a local fast food chain while working. What happened was is she was placing the Fries on the rack/holder on the deep fryer (sits above grease) the rack failed and fell into the grease spashing hot grease all over her forearm. When this happened a manager on duty said "that has always been touchy" They called us and we took her to the hospital right away. After several visits to the burn unit it is deemed that she has deep 2nd to 3rd degree burns all up her forearm (very painful) She is 17 years old. Each time we take the new workmans comp paperwork in to the store a different manager tells us more about this faulty rack system in this fryer (they even closed it until today, reopened it without fixing the problem rack) Another manager told me today that "it falls in all of the time, wish they'd fix it" No one even warned her before the accident of this possibility. She just got a great review after only being there a little over a month (The day before the accident). I have a Workmans Comp attorney that I'm letting handle the BWC side of things. One manager (the only male manager) used to be very friendly with her, saying hi.... each time he sees her now he has not even asked her if she is ok. I think as happend to me for a back injury at a large corporation, he is trying to get her to just quit. This is NOT going to happen.

My question is, BWC is covering the hospital bills, is there another suit that could be filed to cover for pain and suffering and the prior knowledge of this faulty equipment?

Thanks in advance for any advice as my daughter's arm will never look or be the same again.

We are taking pictures of the wound everytime the bandages are removed. This is a very large food chain with billions of burgers sold.....What is the name of your state?

If you are not confident that this attorney is pursuing all avenues of relief, hire another.

"Pain and Suffering" type damages should be dealt with by your current attorney further down the road...

Since it happened at work, is the company "protected" from any other type of suit other than what BWC will pay.

from what you have posted, they were knowingly negligent and failed to provide a safe worplace which removes WC protections in most situations.
