Defamation by Professor?

Do I have a defamation case?
I was arrested for shoplifting, but the charges were dropped when the judge heard that it was my three year old who put a small toy in the diaper bag. If that ordeal wasn't enough, my name was in the paper under arrests. I was to begin my student teaching in January, but the Dean of Education saw my name in the paper, called the local principals and informed them. Each one of them declined my request to student teach at their school because of this. Will I have to move to finish my education. I'm relativly certain that I won't be able to get a job in this area now. Thanks for any advice.

The telling of a truth is not defamation. Although, in this case, it is bad form. I would demand a meeting with this professor and explain what actually happened, and also demand that he contact the court for the resolution of the case.

Then I would also demand he call those he previously called and explain to them his findings. And last, I would demand an apology.

And this is all predicated on the fact that you did NOT do the crime only.

Thank you. Today I learned from one of the principals why I was denied to student teach at his school: The Dean of Education stated that I was convicted of theft. I am shocked. Nearly speechless. (not easly done to a communications major) Now this is NOT even the truth.

Then I suggest you IMMEDIATELY contact an attorney. At the minimum, this idiot needs to be called on the carpet and should be required to write an apology including contacting each and every one he spoke with to apologize for his actions.

At the max, if he does not correct the situation, libel per se is a very good option.

That's a horse of a different color.

Does the prof stand a chance against a defamation suit by you?

Thank you for your advice and support. Unfortunatly, so far I am unable to find an attorney who will take this case against the University. Ah, the joys of living in a small town. I am starting to call around to out of town attorneys. I'll keep you posted.
