What is the name of your state?Mo from Oregon: This is very convoluted with too much information to post here. If you would be so kind as to look at the postings under “personal injury wrongful death.” My posting there is “wrongful death, civil rights.” My screen name is bigdaddy6939. My impression is you may not sue for defamation of character for a deceased person, however, the circumstances are difficult.
I don’t want to be redundant. My daughter and her boyfriend were killed in a motorcycle accident. We believe there was a cover-up, but it will take an act of god to prove. The officer involved knew the kids had spent the past two hours before their death at a local Starbucks drinking coffee. The police press release stated: “ The kids had been out to several parties that night and eluded the officer.” The police also reported this wrong information to the coroner, and the coroner report states in black and white exactly what the police told him. The police department press release officer also told our funeral director the same story. It was plastered on every TV station, newspaper, website, etc . . . The police departments own website also had it listed as above, but has since removed any evidence of the accident at all. All the other incidents for that day are still listed on their website. The kids had only coffee in their system, no drugs or alcohol. We as families have to deal with people every day, we have to tell the correct story of our children, each and every day. We live that horrible day over and over. You can still find website’s defaming their character. We believe this was a malicious attempt on the police department to lead the public to believe “well, those kids deserved what they got.” You can bet the police department expected the kids to have something other then coffee in their system. These were two kids who worked all their lives to do the right thing. Is this what they get? Is this justice? Just tell me if there is a case please?

Do you have a copy of the accident information on the police website that was removed? Keep us updated as you call and consult with attorney's. You consulted with a personal injury attorney but have they actually filed a lawsuit? If they have too much turn over in their firm, you need another firm ASAP.
Mo, Have you consulted with any more attorneys since then?

Yes we are trying to contact several attorneys. I live in Southern Oregon and as you know the accident occurred in the Portland area. My PI friend suggested finding an attorney from Washington State, who also practices in Oregon. I will keep you posted. Thank you so much for your assistance. Mo.

Rmet: Well, thanks to the lovely state of Oregon we live in, you can’t file a defamation of character suit for someone who is deceased. Even though the police department press release was malicious, dead people can’t sue. Family members have to just make due and live with it I guess. It truly disgusts me. They are above the law.

We found a very good investigator who is working the case now and we hope to move forward with the wrongful death lawsuit. I will keep you updated. Thank you again, Mo

Well, at least you have investigated that possibility. I also suggest you contact the consumer protection/investigative reporting sections of major TV stations and see if they would be interested in the story, they often have resources and can get the story out to the public. That may help at least clear your child's name as well as bring the attention to the problem. Also contact your state and federal representitives for assistance. Contacting a Washington Attorney who also practices in OR is also a good idea since this occured near the border.
