State: Louisiana
In short:
Location at a State Vo-Tech, during class time.
My son was asked by a classmate (that he has know and been friends with for at least a year) What was my test grade? He didn't hear what the teacher said.
My son replied, " you got a B. B as in boy."
Classmates reply, " Boy, Boy, who are you calling a boy. boy. I'm a man. Boy. If you call me a boy again I'll bust you in that head of yours."
My son relied, " I didn't call you a boy. I was just telling you that you made a B and not a D. Girl."
The teacher heard the conversation.
The classmate reported to the head of the college that my son called him a boy.
The head of the college said that if the classmate could not "get an understanding between him and my son," that my son would be suspended for using a racial slur against the student.
The teacher did support my son. However, the classmate said that he did not want anything to do with it, "just let it go on through"
My son was suspened for using a racial slur. He did not. Now my son has such a serious and unjust record in his school records.
My son has a bit of a speech slur. So him distinguishing between B and D would be normal. My son also has a treated inoperable aneurysm in the middle of his brain that is filled with platium wire. A hit to his head could be a very bad thing. (Which he was threatened with by the classmate)
The teacher heard the conversation and stated that Justin did not do anything wrong.
But in the end my son was suspended.
Defamation verbal by the classmate and schoolhead. slander or libel recording in his school record. Unfair suspenion.
Is there a case?
