Question and Prospective Client's Answers:
I am currently going thru a custody battle for my 9 year old child in Phoenix Arizona however I reside in Washington State. My ex-husband submiited a letter to the custody evaluator stating that I was in a Psych ward/ mental institution in order to remove me from having custody and defame my character and creditability. What can I do? He sent a written and signed letter to the custody evaluator, his attorney my attorney and my childs therapist! I feel this is slander and want to know what my options are as this letter he wrote was not true.

I once heard a judge say, at the start of a divorce/custody hearing, "Let the lies begin." Typically, courts will not make any decision as important as child custody based on letters written by one ex-spouse about another. There is too often a blatant disregard for the truth in divorce and custody hearings, and custody evaluators, attorneys, therapists and judges are well aware of this. They do independent investigations, and false allegations have a way of being discovered. In the end, this will not benefit your ex-husband at all, and, to have his lies in print is proof of libel.
If you can provide some sort of documentation, from whatever institution he said you were in, stating you were not a patient, that will assist you. Even without documentation, and even if you WERE to have spent some time in a mental health facility, this does not mean the Court will find you unfit to have custody.
Check with Legal Aid in your area, or a Mental Health Advocacy Organization, for help.
