What is the name of your state (only U.S. law)? Colorado

We purchased the home new in 2006, it's a Ranch with a walkout basement.

Just recently the builders came back and said their was a flaw with the back patio that will require them to reinforce it with a full length steel beam. They were suppose to do this at no cost to us UNITL they realized we installed a system under the patio that catches the rain and diverts it to a gutter so the area beneath the patio stays dry.

They are saying it is my responsibility to remove/replace the rain gutter system...the cost to do this is going to be $4,000+

Are they responsible for picking up the tab for the removal/replacement of the gutter system?

What sort of flaw is it that brings the builder back 9 years after your purchase of the house? Has the builder been sued?

Did the builder also install this system or was it something you did after the fact? Is this back patio off the walk out basement or off the main floor? Was their a structural purpose to the system under the patio?

A homeowner in the neighborhood hired a lawyer to review the structural defect and it was determined there was a problem with the patio that comes off the first floor. Because it's a raised ranch, the patio is at least 12 - 15 feet off of the ground. The rain catching system was installed by us and not the builder.

I forgot to mention the system under the patio is not structural, just to keep the area under the patio dry.
I am having trouble picturing anything that could cost that much, and not be able to be disassembled and reassembled after the patio repair.

There's a lot to the water catching system under the patio. The patio is rather large and the water catching system has a lot of "metal" underneath it and has a lot of parts to it. It's not just a piece of plastic with a few screws. They also have to re-seal everything once it's back up.
