What is the name of your state (only U.S. law)? Texas.
I live in TX, the company is in CA, and I purchased the "netbooks" in NV at a trade show. They were selling small "netbooks" that looked just like Eee PCs (same case). They looked like they were running Windows XP, but they were really running CE. The salesman, who was more interested in his own computer with his stocks on it (he admitted this) told us that they were indeed netbooks and made for light use, such as email and web browsing. He had two displays playing a cartoon movie (Madagascar I think).
He explained they didn't have wireless cards, but they did have LAN and then he picked up his Verizon Wireless modem and said, "or you can put one of these on it." ( this card was attached to his personal computer, not one of these) I then looked up wireless dongles on amazon on my phone and saw they were ~$20 and he then said that would work also.
I bought two of them. The receipt has a "no refunds" policy printed on the back of it and a "no warranty" policy referring to RC helicopters and Video Cameras. No where on the receipt or their website are these computers mentioned. (He also said I would be able to go to their website "soon" to get software and drivers. The site still has no information regarding the computers.) About an hour later I opened them up and there was no SD card in either (this was supposed to be included), we walked all the way back and he gave us one SD card.
Late that night, I got back to the hotel after buying a wireless dongle and tried to get it to work, I could not. There were no drivers available that would work anywhere. Placing the computer in proximity to my laptop running a AT&T wireless card led to loud, uncontrollable "chirping" which you could not stop. (Nowhere could I find to turn the speakers off, not even in the OS) I returned to Texas and tried to hook them up to a LAN. The on-board LAN card doesn't work in either unit. Therefore they are defective, yes?
I was told they were for using the internet. They will not connect in any way. I tried to file a chargeback with my CC company and they reversed it, I have yet to learn why. I had two computer techs send letters, I sent pictures and a narrative, tried to return the products to the company, sent email, Fax, and Voicemail to the company as well. (They will not respond to me.) I was fleeced for $667 and some change. What can I do? Small claims court? Can I file in my county or does it have to be NV or CA? Is there a "lemon law" or implied warranty? I bought them on 11/05 and called/emailed/faxed the company to request a refund on 11/14. Will contacting the BBB and CA AG do any good? What would it cost me to sue them for $667?
Thank you
