I am the original owner of home in Riverside, Ca. built in 1986. In January 2001 I was informed by the gas co. that my furnace has been found defective and was condemned. I do not have a working heater in my cold house. I contacted the builder Keusder and they say my warranty is up.I said this has nothing to do with the warranty. The manufacturer of the furnace is no longer in business. Therefore builder says that homeowner is responsible to replace their furnaces. This is a cost of $1700-$2300 which I don't have. These furnaces were built and installed from 1983 to 1992.They have caused fires in homes.Since these furnaces were discovered to be defective in January 2001 wouldn't that be the date of discovery and therefore the builder is liable? I would like to know if I have a case against the builder? maybe take them to small claims court? Please reply ASAP, it is very cold in my home.
