I purchased a leather chair and ottoman in February 2009 from a dealer in SC. It was delivered in June and returned in August due to excess, baggy fabric, crooked seam on chair cushion and uneven arm panels. The head and bustle were extremely baggy and not representative of the picture and store models. All of the cushions have excess fabric and bagging; the store models and all of this mfrs. furniture show tight cushions and no bagginess. It is obvious these are tailoring issues and/or core/cushion issues.
When the chair was returned, the only correction was the seam and now the dealer is telling me I should not have signed the BOL (which is in-transit damage and I was not claiming in-transit damage). I think the dealer is grasping at straws and keeps deferring to the leather mfr who, they claim, the chair falls within their standard. The chair looks like it is 30 years old with the excess wrinkling and creasing of the excess fabric. I wish to contact the leather mfr., but it is doubtful they will talk to me since I am the customer of the furnitue dealer and they want you to deal with the dealer. I have and have remained patient , but am not getting satisfaction.
What are my legal rights in getting this chair replaced? I have given them the opportunity to make the corrections, only to have it returned with one correction - the cushion seam. I might add this is a high-end leather manufacturer who even made a chair specifically designed for our President. I bought with confidence from this company and this chair is not a reflection of their quality.
