I am a insulin pump wearer which delivers insulin at a constant rate through an infusion set that is attached to my body. I have had my pump for nearly 4 years. In Dec 03 Medtronic Minimed changed my infusion sets and sent me new and improved sets. I began to use them and wound up in the hospital in DKA from a kinked cannula with no alarm givin from my pump. I had incurred a 3 days in the ICU stay as well as 2 days on a regular floor.
In February I received a letter that they had recalled these specifc sets and they needed me to retun all the unused sets. Also for February they did send the infusion sets I had originally been wearing since I started pumping. These sets were recalled because the cannulas on these sets were poorly designed and the adhesive was no good.
Can I pursue a lawsuit in this case to regain back my medical expenses and other expenses I am due? I did not suffer long term damage.
