defective shotgun

i have a shotgun that exploded while myy son was unloading it. the gun mfg. says it's the ammuniyion. the ammunition mfg. say that there is no way it's their ammo. their is not a concrete reason for what happened. the gun mfg. has looked at the gun and the ammo mfg. have seen complet photos.
this happened in oct.,2000 in N.C.
what are my time restraints for filing a suite?
can i file a small claims against both?

There are only two possibla way any gun can fire. That is for the firing pin to strike the primer or from excess heat. The gun is at fault. not the amo. If it is a semi-auto or a pump the firing pin jammed and as the shell was being loaded into the chamber the firing pin came in contact with the primer. If the shell was completely in the chamber when it fired then the hammer catch failled or your son pulled the trigger. If the bolt was part way open and the shell just exploded then if it were me I would go to court and at least make them replace the gun.
