we plan to sue the seller of our home for reimbursement of repairs we had to make; the seller refused to honor the warranty of our home. i understand we would name the seller as defendent. the seller is a construction company under the umbrella of a realty company. the head of the realty company's daughter is the president of the construction company. the father (head of the realty company) was the only contact we had when we tried to get the problem fixed; he would not allow us to speak to his daughter. how do i name the father as co-defendant on the small claim complaint form? it would be easy for the daughter to say she has no knowledge of our problem because we never contacted her. the daughter's construction company is in the same building as the father's realty company but different suite #. and yes, we spoke to the father via phone and snail mail. HUD sent a request to the daughter asking they honor the warranty and the daughter refused to respond. any advice would be helpful; we live in the State of New Hampshire. Sincerely, Diane Casey
