I am a Police Officer in a small borough in Pennsylvania. I am full time and I have a written, approved agreement from council for a period of 2 years. My question is: is the Word AGREEMENT the same as the word CONTRACT?. Council stated they can open my Agreement at anytime and change what ever they want due to the fact the it is not a "Contract". Is this legal?. and the second question is: if the word "AGREEMENT" has the same meaning as "CONTRACT" and it is infact a binding contract then when can it be opened and for what reason. I am not a union member, only a full time employee with a 2 year "Agreement". ( Council approved the AGREEMENT in May , 2000 and it has been opened 2 times already because they find something they want to change?). thankyou.... dave

My response:

Yours are very easy questions to ask, and if all you want are "definitions" of the words "Contract" and "Agreement", I can supply those for you. However, your situation requires an in-depth correlation of those words to your specific situation, and that, my friend, would require a study of your "agreement" and then a multi-page memorandum of research to explain those words, and how they relate to your situation.

Contract law is very detailed, with a plethora of varying appellate court interpretations. So, it would be advisable for you to have your "agreement" reviewed by an attorney, and to perhaps, pay for a memoranda and / or verbal consultation on the issues.
