I was defrauded by EBAY. The price came up that I had to bid over $66. I bid $73 at the last second. Next think I know I got a page that said I was the winner at $400. I called the seller and she was willing to sell to the next highest bidder but then I realized this is not what I wanted. I wrote to EBAY, their chat line etc and got no help. They gave me the address of their legal department and I send a full explanation. It was sent certified, return receipt. They accepted the letter but there was not even an acknowledgement. This was a problem with their software and I luckily printed most of the pages that show what happened. What can I do without it costing more than what I had to pay the seller?

Arizona-I'm confused. The answer of I'm not going to get my money back is probably a certainty. But doesn't the fact their softward resulted in fraud mean anything. Why can't they be liable for their mistake. They cannot write a disclaimer against negligence. Thanks

I thought it was their softward that resulted in fraud.

Go the the e-mail that was automatically sent when you placed the bid. Make sure you didn't accidentally double-hit a number. 773, 733, whatever.

Now, you say you had to bid over $67, yet it closed at $400. That's one hell of a minute of bid sniping!

Something doesn't add up here. The seller was willing to sell to the next high bidder as you were only wanting to bid $73. But then you decided you wanted the item and were willing to pay $400. That was YOUR choice. No one was going to hold you to pay that $400. The seller was going to let you off. So you have no recourse because it was YOUR decision to honor the $400 bid.
