i was in an accident december 21, 2007. i was hit head on by another driver, who was charged. that driver has allstate.

after the accident, i had pain in my neck, shoulder, arm and upper back. i saw my family doctor the week after the accident and she referred me to a neurosurgeon. the neurosurgeon told me they would do everything they could to heal me without having to go through surgery.

they took x-rays and recommended a chiropractor. for the first 6 months or so, i made progress. then i started getting tingling in my shoulders and arm. the chiropractor sent me back to the neurosurgeon. he did a nerve test and determined i had a nerve that was being pinched.

he sent me back to the chiropractor and suggested he tried traction. after another 6 or 7 months of treatment, the chiropractor determined he had taken me as far as he could.

i was still having pain in my neck, shoulder and back, so i went back to the neurosurgeon. he ordered a series of test, including an mri and several epidural spinal shots and found what he believes is the problem. since the epidural shot only gave me relief for 5 or 6 days, he is now telling me that surgery is necessary.

i am scheduled to have the surgery september 30th.

does the fact that i will be having surgery 1 year and 9 months after the accident hurt my case?

the adjuster called me once a month for the first year or so for an update, then stopped. since then, i have called him and left him several updates on my progess.

his voice mail says that he is on an extended leave.

I think your bigger problem is you are having surgery very close to the SOL and you will probably still not be ready to settle when it gets here. So you'd better start looking for a lawyer now, before it's too late - you will need one to file suit before the SOL is up, to give you enough time to recover and know what your claim is worth.
